Consumer Building Woes
Everyone has heard the horror stories of tradesmen trashing homes, mangling jobs and costing everyone a lot of money, not to mention ruining your home. Some of us have experienced the drama first hand, stuck with thousands of dollars in contract fees for work that is bodged and completely unsatisfactory.
Recently, HomeSure has been engaged by a victim of one of the worst stories we've ever heard. Our client contracted $25,000.00 of works to be done. By the time this dodgy contractor was done, the contractor's fees were approx $100,000.00 which included an invoice for works carried out but not ordered and therefore disputed as payable. The works are illegal, not compliant with the Building Act and the Queensland Development Codes, no insurances, the scope not complete, there are major defects, structural defects and furthermore the Brisbane City Council has a Statutory Work Order to rectify an area of the works deemed as unsafe. The consensus of independent industry opinion concludes the works require to be demolished and redone to satisfy the statutes of the land, to be carried out by a competent licensed building contractor and be based on pre-approved drawings designed to compliment the pre-1900 cottage. Unfortunately the two areas made available by Queensland legislation for dispute/complaints about the obvious mis-conduct of the trade contractor don't share any concern for justice for the consumer (which cost the victim in the order of $50,000) and ruled in favour of the trade contractor to the extent that the defects and unfinished works are ordered to be rectified by the victim at an excessive cost. Of course the same authority found the trade contractor guilty of mis-conduct but a slap on the wrist was deemed to be 'case closed'!!
